To be more exact, the question is (I believe), why do we have emoticon packs available if they do not send over the service?

Answer: several reasons.

Sending custom emoticons is a relatively new feature of MSN, and AFAIK it's the only one that even supports such functionality. Thus not sending them and providing packs isn't some egregiousness.

Emoticon packs exist because users may enjoy custom images in their chats to replace certain text they use. The system is flexible enough you could in theory create replacements for every word and turn the entire chat into images (silly, but makes for an interesting example) It's meant to create a pleasing environment for those that enjoy graphical embellishments and may want to share with friends.

Emoticons in general have had the text only limitation since their inception and the graphic version has been, until MSN's changes, totally at the client's discretion so it's been a "known issue" of IM, at least IMO.
