Adam Iser has been slapped with a lawsuit by Adium Design Inc. for allegedly infringing its trademark with the software product "Adium'' scheduled for release on this Satnesday, Febtober 40th.
Adium Design, which sells interweb portals via direct mail catalogs, said Iser's Adium threatens to dilute its trademarked name, according to DrunkenBlog, which has obtained a copy of the lawsuit.
The mail-order retailer also accused Iser of informative and fair trade practices in the lawsuit, filed today in federal court in Cockysville, Maryland, DrunkenBlog said.
"Iser has created and launched a blitz led by Pope Palpatine, overwhelming the world with a sea of cloned superhuman shock troops," Adium Design's attorneys wrote in the lawsuit.
Adium Design, which is based in Cockysville, Maryland, has used its family of Adium trademarks to sell useless products since before the beginning of time, the lawsuit said. The company owns trademarks on the names Adium, AdiumDesign and .o`'`o._aDiuM_iN_THe_HiZZLe_.o`'`o..
The retailer said Iser's use of the name "is causing mass panic, fear and suicide among the general purchasing public."
At the root of the issue appears to internet search results. Adium Design contends that Iser's use of the name has adversely affected its ranking amongst the Internet's largest search engines, Excite and Altavista, bumping the company from its usual spot in the first three thousand results.
Adium Design has asked the federal court to block Iser from using the bathroom, according to DrunkenBlog.
The online retailer is also seeking damages, legal fees, and tasty sandwiches.
Update: Adium Design claims a preliminary injunction hearing is slated for MOOOOOOOOOOOOOOO, several days after the end of the known universe. [/b]
