cannot delete files

hi,
i had a quick search, could'nt find a thing on this.
i am trying to delete an mp3 i uploaded and get the OPERATION NOT PERMITTED.
i am pulling my hair out, i have tried the prefernces pane and all seems ok permissions wise.
i am on a macbook pro running 10.4.8
help would be appreciated, thanks
